Terms of Service

By creating an account or using any part of the Service, you confirm that:

• You are at least 18 years of age;
• You have read, understood, and agree to these Terms and our Privacy Policy;
• You will use the Service only for lawful personal study purposes.

ExamCite provides exam preparation tools including multiple-choice practice questions, timed exam simulations, performance analytics, and AI-powered study assistants. ExamCite offers multiple exam-preparation modules, each covering a different professional or civic licensing exam; each module has its own module-specific disclaimers, set out below.

ExamCite is currently accessible via a web application, with native mobile apps planned for a future release. All features available at your subscription tier can be accessed from any supported device. These Terms also govern your use of the free public handbook assistant at ask.examcite.com, which is part of the Service and requires no account.

3.1 Free Tier

The Service is free to access. What the free tier includes varies by exam module and is shown in the app; some modules are offered in full at no charge. No payment information is required.

3.2 Paid Subscription Tiers

Paid subscriptions unlock unlimited practice exams, all topic filters, full progress history, and access to the AI-powered study assistants, subject to the entitlements of your plan. As new exam modules are added, paid subscribers receive access automatically at no additional charge.

3.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Web subscriptions are billed via Stripe and can be managed in your Account settings.

3.4 Free Trial (if offered)

If a free trial is offered, unused trial time is forfeited when you purchase a subscription. Trial terms will be disclosed at the point of offer.

3.5 No Lifetime Tier at Launch

ExamCite does not offer a “Lifetime” subscription tier at v1.0 launch. If introduced in a future version, “Lifetime” refers to the operational life of the Service — not the biological life of the purchaser. Lifetime purchasers would receive a minimum 90-day notice before any discontinuation.

3.6 Refund Policy

Web subscription refunds are processed via Stripe in accordance with Stripe's terms and applicable law.

3.7 One-Time Access Passes

Some exam modules may offer a one-time access pass as an alternative to a subscription. A one-time pass is a single payment, not a subscription. It does not automatically renew, and §3.3 does not apply to it. It grants access to the module for a fixed period, which is stated at the point of purchase; when that period ends, access to paid features stops and no further charge is made. You will not receive a renewal reminder, because there is no renewal. If you want continued access after a pass expires, you may purchase another pass or subscribe, where either is offered.

One-time passes are not currently offered. This section describes how they will work if and when a module offers one.

The Service offers three AI study assistants to signed-in users — a Handbook assistant that answers questions about the official handbook, a Tutor that explains material you are struggling with, and a Coach that suggests what to study next — together with automatically generated coaching shown after an exam session and on your Progress page. ExamCite also operates a free public handbook assistant at ask.examcite.com, which requires no account.

By using any of these features, you acknowledge and agree that:

• Responses are AI-generated and grounded on the 2025 California Notary Public Handbook, but may contain inaccuracies or errors;
• Responses are for educational purposes only and do not constitute legal advice;
• You should verify important legal rules against the official handbook;
• The developer is not liable for consequences arising from reliance on AI-generated responses;
• Which assistants are available to you, and how many messages you may send each day, are determined by the plan applying to your account and to the exam module you are studying. Availability may differ between exam modules and may change. The public handbook assistant is subject to a separate daily limit applied per internet connection;
• Your conversations with the Handbook assistant and the Tutor are not retained between sessions. The coaching message generated after an exam session, and the performance summary shown on your Progress page, are stored and associated with your account so that they do not have to be regenerated. How all of this data is handled is described in our Privacy Policy.

5.1 Service Ownership

The Service, including its code, design, question content, explanations, and AI models, is the property of the developer. All rights reserved. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service. This includes the public handbook assistant at ask.examcite.com.

5.2 Content Sources

Practice questions and AI assistant responses are derived from the California Notary Public Handbook, a public government document. All question text is original content authored by the developer.

5.3 User Data

You retain ownership of data you input into the Service. By using the Service, you grant the developer a limited license to use this data to provide and improve the service, as described in the Privacy Policy.

• We collect your email address, exam session data, and usage analytics.
• We do not sell your personal data to third parties.
• We use Firebase (Google) for authentication and data storage, and Stripe for payment processing. Our AI study assistants are powered by Anthropic (Claude API), OpenAI and Pinecone, which receive the text of your assistant queries. These vendors have their own privacy policies.
• Some exam modules may be used without an account. Where they are, we hold no information that identifies you personally, but your study activity is still stored against an anonymous identity.
• California residents have rights under the CCPA, including the right to know what data we collect, the right to delete it, and the right to opt out of sale (we do not sell data).
• To delete your account and data, use the deletion option in your Account settings. You may also contact us at support@examcite.com.

You agree not to:

These rules, and the prohibition below on submitting real exam questions, apply equally to your use of ask.examcite.com.

• Use the Service for any unlawful purpose;
• Attempt to reverse-engineer, decompile, or extract source code from the Service;
• Share, resell, or redistribute your account credentials or subscription access;
• Attempt to circumvent the subscription paywall or free tier limits through technical means;
• Use automated tools (bots, scrapers) to access or extract content from the Service;
• Submit, upload, paste, or otherwise introduce actual CPS HR Consulting examination questions, official answer keys, or other copyrighted exam materials into the Service (including through the AI Chat feature or ask.examcite.com). All practice questions in the Service are original works derived from publicly available government documents.

8.1 No Exam Pass Guarantee

ExamCite is a study aid. The developer makes no guarantee that use of the Service will result in passing the California Notary Public exam or any other exam.

8.2 Content Accuracy

While the developer makes reasonable efforts to ensure accuracy, practice question content and AI responses may contain errors. The official California Notary Public Handbook is the authoritative source. The developer is not liable for exam failure resulting from inaccurate Service content.

8.3 Service Availability

The Service is provided “as is.” The developer does not warrant uninterrupted or error-free service. The Service may be unavailable due to maintenance, third-party service outages (for example Firebase, Anthropic, OpenAI, Pinecone or Stripe), or other factors outside the developer's control.

8.4 Limitation of Liability

To the maximum extent permitted by applicable law, the developer's total liability for any claims arising from use of the Service shall not exceed the amount you paid for your subscription in the three (3) months preceding the claim.

The developer reserves the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. You may terminate your account at any time by cancelling your subscription and requesting account deletion. Upon termination, your right to use the Service ceases immediately.

• Monthly and Annual subscribers will not be charged after their current billing period ends. No pro-rated refunds unless required by applicable law.
• The developer will make reasonable efforts to provide an export of user progress data upon request during any notice period.

The developer may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree with updated Terms, you must cancel your subscription and stop using the Service.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Diego, California.
